Best Practices

 

In response to recent changes to consumer protection laws, the American Land Title Association (“ALTA”) has developed title industry “Best Practices” as a tool to help title companies satisfy new regulatory requirements. Even though not mandatory, Fountain City Title Ltd. has embraced ALTA Best Practices because we believe it is good for the businesses and individuals we serve. As an indicator of our commitment to following Best Practices, Fountain City Title, Ltd is an approved registered agent for Secure Insight.

 

Below is a brief summary of our ALTA Best Practices policies:

 

  • Procure and maintain current licenses necessary to conduct the business of title insurance and settlement services.

 

  • Adopt and maintain written procedures and controls for Escrow Trust Accounts.

 

  • Adopt and maintain a written privacy policy and information security program to protect non-public personal information (“NPI”).

 

  • Adopt real estate settlement procedures and policies to ensure compliance with applicable laws.

 

  • Adopt and maintain written procedures related to title policy production, delivery, reporting and premium remittance.

 

  • Maintain professional insurance and fidelity coverage.

Types of Nonpublic Personal Information We Collect

We collect nonpublic personal information, about you that is provided to us by you or obtained by us with your authorization.

 

Parties to Whom We Disclose Information

For current and former clients, we do not disclose any nonpublic personal information obtained in the course of our practice, except as required or permitted by law. In a generic sense, any information a client provides us is likely to be considered nonpublic personal information and receives confidential treatment. Permitted disclosures include, for instance, providing information to our employees, and in limited situations, to unrelated third parties who need to know that information to assist us in providing services. In all such situations, we stress the confidential nature of information being shared. There are also occasions where information is exchanged between Fountain City Title Ltd. and Bish Butler & Thompson, Ltd.

 

Protecting the Confidentiality and Security of Current and Former Clients Information

We retain records relating to services that we provide so that we are better able to assist you with your needs and, in some cases, to comply with guidelines of our profession. In order to safeguard your nonpublic personal information, we maintain physical, electronic, and procedural safeguards that comply with the rules of professional conduct applicable to us.
